Requirement to get a marriage license in Texas

One of the first question a bride will ask herself after saying “yes, I will marry you” is what are the legal requirements to bewed in the state of Texas. As a newcomer photographer to the San Antonio area, I decided to find out so I can share the requirements with you.

When should you apply for your Texas’ marriage license?

One of the first things I found out is that Texas, like Puerto Rico, has marriage license timing requirements. To ensure that you will meet Texas’ marriage license timing requirement it is adviced that you apply one to two weeks before the scheduled date of your wedding. You can obtain your marriage license at any County Courthouses across the state.

The license is valid in any county of Texas and up to 90 days after the date of issuance.


Is there a waiting Period in Texas?

Yes, there is a 72-hours waiting period from the time the license was purchased until the time the ceremony can be performed. But the ceremony must take place within 90 days from the date you purchased your license. Otherwise, the license expires.

Applicants who are on active military duty are exempt from the 72 hours waiting period.


Who can marry legally in the State of Texas?

  • If you are 18 or older, you can marry without parental consent.
  • If you are 16 to 17 you must have parental, managing conservator or legal guardian consent or judicial approval.
  • If you are under 16, you must provide a court order.


Who can marry in the State of Texas and apply for the Marriage License?

  • Any person 18 years or older.
  • If you are 16-17 with parental consent or judicial order.


Who can apply for the Marriage License? What documents must you bring?

Both applicants must be present when applying. If you are 18 years old or older you will need to bring one of the following forms of identification to prove identity and age(no plain copies or expired documents will be accepted):

  • Original or certified copy of birth certificate,
  • Valid drivers license,
  • Military id,
  • Valid id issued by the Department of Public Safety,
  • Valid passport.
  • You must also bring your social security card.

If you are between 15 to 17, you must provide a certified copy of your birth certificate, and the parent, managing conservator or legal guardian must also present identification and document confirming proof of custody or guardianship or conservatorship. Social security required for both applicants.


Does Texas require couples to do a blood test?

Texas does not require a blood test to obtain a marriage license.


Who can perform a marriage in Texas?

A legally binding marriage ceremony can be performed by:

  • A licensed or ordained Christian minister or priest.
  • A Jewish Rabbi.
  • A person who is an officer of a religious organization and who is authorized by the organization to conduct a marriage ceremony.
  • Any Federal or State of Texas judge.


How much it cost?

For Bexar County applicants, the cost is $81 cash (checks are not accepted.)


What if I am divorced?

A marriage license may not be issued if either applicant has been divorced within the last 30 days unless the applicant were divorced from each other or the prohibition against remarriage is waived by the court.


Do I need to do anything after the wedding?

Yes, you will need to return the original license to the County Clerk in the county where you purchased it. You will receive the official copy by mail.
